At KISS consulting BV - DownDraft Chef we want to ensure that our relationships with our customers run as smoothly as possible. We value the trust you place in KISS consulting BV - DownDraft Chef and take your rights very seriously. With the following terms of sale, we aim to provide you with a clear and concise overview of your rights, and sometimes also your obligations. If anything is unclear, we appreciate it if you let us know.
Article 1 - Definitions
1.1. "General Terms and Conditions of Sale" means the provisions set out below.
1.2. "KISS consulting BV - DownDraft Chef" means: KISS consulting BV - DownDraft Chef , the user of these terms.
1.3. "Offer" means: any offer by KISS consulting BV - DownDraft Chef to enter into an agreement with it.
1.4. "Order" means: any acceptance of an offer from KISS consulting BV - DownDraft Chef .
1.5. "Agreement" means: any acceptance by KISS consulting BV - DownDraft Chef of an order.
1.6. "Goods" means: all tangible objects to which agreements between the buyer and KISS consulting BV - DownDraft Chef relate.
1.7. "Delivery" means: the actual availability of goods to the buyer by or on behalf of KISS consulting BV - DownDraft Chef .
Article 2 - Applicability
2.1. All offers, orders and agreements are subject to the provisions of these General Terms and Conditions of Sale, unless KISS consulting BV - DownDraft Chef expressly deviates from them in its offers.
2.2. By ordering, you accept the applicability of the General Terms and Conditions of Sale in force at that time.
Article 3 - Offers, Orders and Agreements
Offers
3.1. All offers from KISS consulting BV - DownDraft Chef are without obligation and may be revoked.
3.2. The duration of all offers is: while stocks last, or the duration as stated on the website.
3.3. After the duration of an offer has expired, you can no longer make use of the relevant offer.
Orders
3.4. You can order in the manner described on the website.
3.5. KISS consulting BV - DownDraft Chef does not accept orders:
- from persons under the age of 18;
- if KISS consulting BV - DownDraft Chef cannot verify the provided address information as correct.
3.6. KISS consulting BV - DownDraft Chef is also entitled to refuse orders on other grounds or to attach special conditions to the agreement.
3.7. If an order is not accepted, or if KISS consulting BV - DownDraft Chef wishes to attach special conditions to the agreement, KISS consulting BV - DownDraft Chef will notify you of this no later than 30 days after receipt of the order.
Agreement
3.9. An agreement is only concluded after your order has been confirmed by KISS consulting BV - DownDraft Chef by email.
Article 4 - Prices and Costs
4.1. The prices listed on the website for the offered goods at the time of the order apply.
4.2. The prices are in Euros, including VAT and excluding shipping costs, unless otherwise stated or agreed in writing.
4.3. KISS consulting BV reserves the right to change the prices of the goods, especially if a statutory price-determining factor gives cause for this.
4.4. Shipping of the order via this method is always at the customer's responsibility. All damages, theft, loss, strikes, and others cannot be claimed from KISS consulting BV .
Article 5 - Payment
5.1. You can pay the purchase price of the goods you have ordered, plus the additional costs, in various ways. KISS consulting BV - DownDraft Chef reserves the right to exclude certain payment methods.
Credit Card
5.2. If you choose to pay by credit card, you authorize KISS consulting BV - DownDraft Chef to check before processing your order whether your credit card is valid and whether sufficient credit is available for the purchase amount, and to reserve this amount prior to purchase.
5.3. Payment by credit card is made immediately after the goods you ordered are shipped from our warehouse to you. KISS consulting BV - DownDraft Chef then debits the amount owed - of course, via a secure procedure - from your credit card.
Article 6 - Delivery
6.1. KISS consulting BV - DownDraft Chef delivers the purchased products as soon as possible - and no later than within 14 days - to the address you specified when ordering, as long as stocks last. All goods are generally available from stock. However, it may happen that an item is temporarily out of stock. In the event that an accepted order cannot be delivered in whole or in part, or delivery is delayed, KISS consulting BV - DownDraft Chef will inform you within 14 days after your order is placed. KISS consulting BV - DownDraft Chef then has the right to terminate the agreement.
6.2. If a delivery period is specified, it is purely indicative. Failure to meet the delivery period cannot give rise to any compensation on our part, as the delivery periods are provided solely for information and without any commitment.
Article 7 - Ownership of Goods
7.1. KISS consulting BV - DownDraft Chef retains ownership of the goods delivered to you until you have paid in full all amounts owed to KISS consulting BV - DownDraft Chef .
Article 8 - Returns
The provisions of this article apply only to customers who purchase items online from KISS consulting BV - DownDraft Chef in their capacity as consumers.
The customer has the right to revoke the agreement within 14 calendar days without giving any reason.
The withdrawal period expires 14 calendar days after the day on which the customer or a third party designated by the customer, who is not the carrier, physically takes possession of the goods.
To exercise the right of withdrawal, the customer KISS consulting BV - DownDraft Chef, Rekhovenstraat 11, 3560 Lummen, Belgium, info@downdraftchef.com must inform of his decision to revoke the agreement by means of an unequivocal statement (e.g., in writing by post or email).
The customer must return the goods to KISS consulting BV - DownDraft Chef, Rekhovenstraat 11, 3560 Lummen, Belgium, info@downdraftchef.com without delay and in any event no later than 14 calendar days from the day on which he notifies KISS consulting BV - DownDraft Chef of the withdrawal from the agreement. The deadline is met if the customer sends back the goods before the period of 14 calendar days has expired. The customer bears the cost of return shipping.

Article 9 - Incorrect Delivery
9.1. You are obliged to inspect the delivered goods upon receipt. If the delivered goods do not conform to the agreement (wrong or insufficient delivery, and/or with a defect or damage), you must immediately notify KISS consulting BV - DownDraft Chef in writing immediately after delivery of the goods. You must then return incorrectly delivered or damaged goods immediately upon receipt, stating the defect.
Article 10 - Miscellaneous
10.1. If one or more provisions of these Terms or any other agreement with KISS consulting BV - DownDraft Chef should be in conflict with any applicable legal provision, the relevant provision will be void and will be replaced by a new legally permissible comparable provision to be determined by KISS consulting BV - DownDraft Chef.
10.2. KISS consulting BV - DownDraft Chef reserves the right to amend these General Terms and Conditions.
10.3. The conditions applicable at the time of the conclusion of the agreement will apply to the agreement.
10.4. The parties accept electronic evidence (email - backup).
Article 11 - Warranty
Under the law of 21 September 2004 on the protection of consumers in respect of the sale of consumer goods, the consumer has statutory rights. This statutory warranty applies from the date of purchase by (where applicable, delivery to) the first owner. Any commercial warranty does not affect these rights.
To invoke the warranty, the customer must be able to present the purchase receipt. Customers are advised to keep the original packaging of the goods.
For items purchased online and delivered to the customer’s home, the customer must contact the KISS consulting BV - DownDraft Chef customer service in advance, after which the customer must return the item at his own expense to KISS consulting BV - DownDraft Chef.
The seller's warranty service will then contact the product supplier, who will decide whether a defect is covered by the warranty. If not, the products will remain the property of the buyer and must be collected from the store unrepaired.
When a defect is discovered, the customer must inform KISS consulting BV - DownDraft Chef as soon as possible. In any case, any defect must be reported within 2 months of its discovery by the customer. After this period, any right to repair or replacement expires.
The (commercial and/or statutory) warranties never apply to defects arising from accidents, neglect, falls, improper use of the item, failure to follow the instructions or manuals, alterations or modifications to the item, rough handling, poor maintenance, or any other abnormal or incorrect use.
It also does not apply to items with a shorter lifespan or wear parts.
The warranty is not transferable.
